Terms of Use

The terms that govern your access to and use of the PerfHawk web-performance monitoring service.

User: any person or organisation that creates an account or uses the service (“you”).

1. Acceptance

By creating an account or using PerfHawk, you accept these Terms of Use. If you are using PerfHawk on behalf of an organisation, you confirm that you are authorised to bind it to these terms. If you do not agree, do not use the service.

2. The service

PerfHawk is a web-performance monitoring service. It measures the loading performance and Core Web Vitals of the web pages you choose to monitor, and tracks them over time, using Google's public PageSpeed Insights API (Lighthouse lab data) and Chrome UX Report API (CrUX field data). It can run scheduled checks and notify you of regressions.

PerfHawk does not operate a crawler and does not perform security testing, penetration testing, or any intrusive analysis. It retrieves performance data about a page from Google's APIs; it does not access private areas of your site or bypass any technical protection.

3. Account & eligibility

  • You must provide accurate registration details and keep them up to date.
  • You are responsible for the security of your credentials and for all activity under your account.
  • You must be able to form a binding contract and not be barred from using the service under applicable law.
  • Notify us promptly at [email protected] of any unauthorised use of your account.

4. Plans, subscriptions & payment

PerfHawk offers a free plan and one or more paid plans, with limits (such as the number of monitored URLs and websites) described on our pricing page. Paid plans are billed in advance on a recurring basis until cancelled.

  • You can cancel at any time; cancellation takes effect at the end of the current billing period.
  • Except where required by law, payments already made are non-refundable for partial periods.
  • We may change plans, limits, or prices; we will give reasonable notice of changes that affect an active paid subscription, and changes apply from your next billing period.

5. Acceptable use

You are responsible for the URLs you submit and how you use the service. You agree not to:

  • use PerfHawk for any unlawful purpose, or to harass, defraud, or infringe the rights of others;
  • attempt to overload, disrupt, or circumvent the limits or security of the service;
  • access the service other than through the interfaces we provide, or scrape, resell, or sublicense it without our written consent;
  • reverse engineer or attempt to derive the source code of the service, except as permitted by law;
  • submit URLs in a way that infringes a third party's rights or applicable law.

Because PerfHawk reads only public performance data served by Google's APIs, you do not need to own a site to monitor it. You remain solely responsible for ensuring your use complies with applicable law.

6. Third-party data & availability

Performance results depend on Google's PageSpeed Insights and Chrome UX Report APIs. Their availability, quotas, coverage, and accuracy are outside our control. Field (CrUX) data is only available for pages with sufficient real-user traffic, so some pages may return lab data only or no field data at all. We are not responsible for changes, errors, or interruptions originating from these third-party services.

7. Intellectual property

The service, its software, design, and content are owned by PerfHawk and protected by intellectual-property law. We grant you a non-exclusive, non-transferable right to use the service for the duration of your subscription. The data and reports generated for your account are yours to view and use; you grant us the limited rights needed to operate the service and produce those reports.

8. Service changes & beta features

We may update, add, or discontinue features. Some features may be offered as beta or preview and provided without warranty; we may modify or withdraw them at any time. We aim for high availability but do not guarantee uninterrupted or error-free operation.

9. Warranties

The service is provided “as is” and “as available”. To the extent permitted by law, we disclaim all implied warranties. PerfHawk does not guarantee the accuracy or completeness of performance measurements, the absence of false readings, or any particular improvement in your site's performance or search ranking. Reports do not replace your own engineering judgment or testing.

10. Limitation of liability

To the extent permitted by law, PerfHawk shall not be liable for indirect or consequential damages, including loss of revenue, opportunity, data, or reputation, arising from use of the service.

Except where mandatory law provides otherwise, our total liability arising from or relating to the service is capped at the lower of (a) the amount you paid us in the twelve (12) months before the event giving rise to liability, or (b) €500. No limitation applies in cases of gross negligence, wilful misconduct, or any liability that cannot be excluded by law.

11. Indemnification

You agree to indemnify and hold PerfHawk harmless from any claim, loss, or cost (including reasonable legal fees) arising from your breach of these terms, your misuse of the service, or your unlawful submission or use of URLs and data.

12. Suspension & termination

You may stop using the service and close your account at any time. We may suspend or terminate access, with notice where practicable, if you breach these terms, if we reasonably suspect abuse or a security risk, or if required by law. On termination, your right to use the service ends; provisions that by nature should survive (such as liability, indemnification, and intellectual property) continue to apply.

13. Governing law & jurisdiction

These terms are governed by French law, subject to mandatory public-order rules and directly applicable European regulations. Any dispute relating to their validity, interpretation, or performance falls under the exclusive jurisdiction of the courts of Paris, including in the event of multiple defendants or third-party claims.

14. Changes to these terms

We may update these terms from time to time. We will post the new version on this page and update the version date above. Continued use of the service after a change constitutes acceptance of the updated terms.
